TERMS OF USE FOR “FOUNDATIONS AND FUTURES: MULTIMEDIA TEXTBOOK ON ASIAN AMERICANS AND PACIFIC ISLANDERS”

Welcome to the UCLA Asian American Studies Center (“AASC”) Website for “Foundations and Futures: Multimedia Textbook on Asian Americans and Pacific Islanders.” By accessing or using this Site, you agree to comply with and be bound by the following Terms of Use; if you do not agree, do not use the Site. The AASC reserves the right, at its sole discretion, to change, modify, add or remove portions of these Terms of Use at any time. You are responsible for checking these Terms of Use periodically for changes. Please read these terms carefully before using the Site or any of its Content.

1. Definitions

“Site” refers to the AASC Website for “Foundations and Futures: Multimedia Textbook on Asian Americans and Pacific Islanders,” all ancillary content, and all related online platforms where the content is hosted.

“Content” means all textbook chapters, lesson plans, and accompanying educational materials published on the Site

“Users” refers to any individual or entity accessing or using the Site.

2. License and Permitted Use

  • The Site and its Content are intended solely for personal, non-commercial use.
  • The Content is provided free of charge for lawful, personal, and non-commercial educational purposes only. Permitted uses include:
    • Classroom instruction
    • Individual study
    • Research within an educational institution
    • Sharing with students or colleagues for educational activities within a non-commercial context
    • Making the Site available to the public in libraries, museums, community spaces, and workplaces, so long as no charge is assessed to the User to access the Site
    • Using the narrative histories and/or media objects for personal research papers, school assignments, creative projects, etc., so long as the uses retain a non-commercial character and proper attribution is provided
  • Users may view, download, and print Content for these purposes, provided all copyright and proprietary notices are retained on any copies.
  • To the extent a User wishes to use or copy any multimedia assets contained in the Site, it should double-check with the copyright owner of each such asset whether the use the User is contemplating is allowable.
  • Any citation to, quotation of, or other educational non-commercial use of the Site’s Content must provide proper, appropriate attribution. 3. Prohibited Uses

  • The Content may not be used, distributed, or otherwise exploited for any commercial purpose, commercial advantage, or fee, unless otherwise previously agreed in writing by the AASC. The following are only illustrative (and not exhaustive) examples of prohibited uses:
    • Selling, renting, licensing, or distributing the Content for compensation
    • Incorporating Content into commercial products or services
    • Posting or reproducing Content on other websites or printed publications for commercial gain
    • Incorporating or otherwise using Content for, or in conjunction with, advertising, marketing, or promotional activities
  • Users may not modify, edit, create derivative works from the Content, or otherwise exploit the Content for any commercial or non-educational purpose, without prior written consent from the AASC.
  • Users may not incorporate or quote from the Content, even for an educational purpose, without providing proper attribution (as discussed above).
  • Users may not delete, remove, obscure, or alter the Site’s copyright or other proprietary rights notices, or security-related features, whether or not such notices or features are affixed visibly, digitally via Digital Rights Management, or by any other means.
  • Users may not input or upload the Site or any of its Content into any GenAI tools or applications that will use the Content for purposes not essential to its non-commercial educational purpose, including but not limited to developing, training, testing, or otherwise improving any machine-learning algorithms or artificial intelligence models, whether directly or indirectly, and whether for yourself or a third party.
  • Users may not use any “deep-link”, “page-scrape”, “crawler,” “robot”, “spider” or other automatic device, program, software, algorithm, methodology, means or process, or any similar or equivalent manual process, to access, acquire, or copy any portion of the Site or any of its Content.

4. Intellectual Property

  • Unless otherwise indicated, all Content contained on the Site, including but not limited to its selection, collection, compilation, and arrangement, is owned, controlled, or licensed by or to the AASC, and is protected by trade dress, copyright, trademark, and various other intellectual property and proprietary rights. 
  • Users must retain all copyright and proprietary notices on any copies of the Content.
  • No transfer of ownership or rights is granted except as expressly stated in these Terms.

5. Compliance with Law

You agree to comply with and are solely responsible for ensuring compliance with all applicable Federal, State, and local laws, regulations, and policies (including School District policies) in the jurisdiction in which you reside or access the Site.

6. User Conduct

  • Users must use the Site and Content in a manner consistent with educational purposes.
  • Users may not circumvent, disable, or interfere with the security features of the Site.
  • Any attempt to use the Content in violation of these Terms of Use will result in immediate termination of access and may result in legal action.

7. Privacy

This section may apply if you are an Instructor who registers on the Site to access Lesson Plans, or if the Site in the future requires registration of Users to access the Site or portions or versions thereof. The AASC values your privacy and does not sell, share, or rent your personal information to anyone. Please read our Privacy Policy for details about how we collect, use, and disclose your personal information. The Privacy Policy’s terms are hereby incorporated by this reference into these Terms of Use.

8. Disclaimer and Limitation of Liability

  • The Content is provided “as is” for general educational and informational purposes. The AASC makes no warranties regarding the accuracy, completeness, or fitness for a particular purpose.
  • The AASC is not liable for any damages arising from the use or misuse of the Content or Site.

9. Amendments

  • The AASC reserves the right to update or modify these Terms at any time. Continued use of the Site after such changes constitutes acceptance of the new Terms.

10. Governing Law

  • These Terms are governed by the laws of California and the United States, without regard to conflict of law principles. Unless it is expressly forbidden by law, you agree to the personal jurisdiction by and venue in the state and federal courts in Los Angeles County, California, and waive any objection to such jurisdiction or venue.
